This Acceptable Use Policy ("AUP") sets out the rules governing your use of the services provided by Katanso Solutions Ltd (trading as "Kumo"), including the Kumo Platform (platform.kumo.earth), the Kumo Terminal (terminal.kumo.earth), and any related services (collectively, the "Services").
This AUP forms part of, and is incorporated by reference into, our Terms of Service. Capitalised terms used but not defined in this AUP have the meanings given to them in the Terms of Service.
By accessing or using the Services, you agree to comply with this AUP. Kumo reserves the right to suspend or terminate access for any user who violates this policy.
Prohibited Activities
You must not, and must not attempt to, use the Services to:
Security and Integrity
Access or attempt to access any part of the Services, systems, networks, or data that you are not authorised to access, including other users' accounts or data.
Circumvent, disable, or interfere with any security, authentication, access control, rate-limiting, or usage monitoring features of the Services.
Introduce or transmit any virus, worm, trojan horse, ransomware, spyware, adware, or other malicious code, file, or programme to or through the Services.
Conduct or attempt any denial-of-service attack, distributed denial-of-service attack, or any other action designed to degrade, disrupt, or impair the performance, availability, or integrity of the Services.
Probe, scan, or test the vulnerability of the Services or any associated system or network, or breach any security or authentication measures, except with Kumo's prior written consent as part of an agreed security assessment.
Interfere with or disrupt the Services, servers, or networks connected to the Services, or violate the requirements, procedures, or policies of networks connected to the Services.
Data and Content
Use the Services in any manner that violates the Data Licence restrictions set out in Section 5 of the Terms of Service, including any unauthorised redistribution, scraping, systematic extraction, or commercial exploitation of the Data.
Upload, submit, or transmit any content that: (a) is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable; (b) infringes the intellectual property rights, privacy rights, or other rights of any third party; or (c) contains personal data of any individual without that individual's consent or another lawful basis for processing.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity, including Kumo.
Use any automated means (including bots, scripts, spiders, crawlers, or scrapers) to access the Services or collect data from the Services, except through APIs expressly provided by Kumo for that purpose and used in accordance with applicable API terms.
Legal Compliance
Use the Services for any purpose that is unlawful under the laws of England and Wales or any other applicable jurisdiction, including any activity that violates applicable sanctions, export controls, anti-money laundering, or anti-bribery and corruption laws.
Use the Services in connection with money laundering, terrorist financing, sanctions evasion, tax evasion, fraud, or any other financial crime.
Use the Services to process, store, or transmit data in violation of applicable data protection or privacy laws, including the UK GDPR and the Data Protection Act 2018.
Use the Services to engage in or facilitate market manipulation, insider trading, or any other activity that violates applicable securities laws or financial regulations.
General
Use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with any other party's use of the Services.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data models, or underlying structure of the Services or any part thereof, except to the extent expressly permitted by applicable law (including Section 50B of the Copyright, Designs and Patents Act 1988 for interoperability purposes).
Encourage, facilitate, or instruct any third party to engage in any of the activities prohibited by this AUP.
Reporting Violations
If you become aware of any violation of this AUP, please report it to us at support@kumo.earth. We take all reports seriously and will investigate promptly.
Consequences of Violation
Kumo may, at its sole discretion and without prior notice, take any action it deems appropriate in response to a violation of this AUP, including: issuing a warning; suspending or restricting access to the Services; terminating the Account and Subscription; removing or disabling access to any content that violates this AUP; and reporting the violation to law enforcement or regulatory authorities.
Any such action is without prejudice to Kumo's other rights and remedies under the Terms of Service or applicable law, including the right to seek damages and injunctive relief.
Changes to This Policy
Kumo reserves the right to modify this AUP at any time. Changes will be notified in accordance with Section 14 of the Terms of Service.
